USER/CLIENT AGREEMENT & INSURANCE COVERAGE AND LIABILITY 

1. Insurance Coverage Provided

Request A Driver LLC (“Company,” “we,” “us,” or “our”) maintains the following insurance coverage for all vehicles operated by our professional drivers on behalf of clients:

• Collision Coverage: $100,000 per occurrence
• Liability Coverage: $1,000,000 per occurrence

This insurance is provided through RLI Insurance Company and applies to all vehicles in our care, custody, and control during the provision of services.

2. Primary Insurance

The insurance coverage maintained by Request A Driver LLC shall serve as the primary insurance for any vehicle operated by our drivers in the course of providing services to you, regardless of:

• The registered owner of the vehicle
• The license plate jurisdiction or registration
• Any personal insurance policy you may maintain on the vehicle
• The state in which the vehicle is registered or the service is provided

Our insurance shall be primary and non-contributory, meaning it will respond first to any covered claim before any other applicable insurance policies.

3. Deductible Responsibility

Request A Driver LLC will be responsible for paying any insurance deductibles associated with covered claims under our collision and liability insurance policies. Clients will not be charged for deductibles on covered incidents.

4. Client Responsibilities

By using our services, you acknowledge and agree that:

• You must provide accurate and complete information about your vehicle, including make, model, year, VIN, current condition, and fuel type
• You must specifically disclose if your vehicle has a diesel engine on our driver request page
• Your vehicle must be in safe operating condition and compliant with all applicable laws
• You will disclose any known mechanical issues or defects prior to service
• You maintain current vehicle registration and any required inspections

5. Diesel Vehicle Disclosure Requirement

IMPORTANT: If your vehicle is equipped with a diesel engine, you MUST indicate this on our driver request form when booking services.

Failure to disclose that your vehicle has a diesel engine absolves Request A Driver LLC of any and all responsibility for damages resulting from incorrect fuel being dispensed into the vehicle, including but not limited to:

• Engine damage from misfueling
• Fuel system contamination or repairs
• Towing and recovery costs
• Fuel tank cleaning or replacement
• Any consequential or related damages

If you fail to disclose your vehicle’s diesel engine, you assume full financial responsibility for all damages and costs associated with misfueling. Our insurance coverage will NOT apply to such incidents.

It is solely your responsibility to ensure accurate vehicle information, including fuel type, is provided at the time of booking.

6. Coverage Limitations and Exclusions

Our insurance coverage does NOT cover:

• Pre-existing damage to your vehicle
• Damage resulting from mechanical failure or defect
• Damage occurring outside the scope of services provided
• Personal property left inside the vehicle
• Intentional acts or gross negligence by the client
• Damage from acts of God, war, terrorism, or civil unrest
• Loss of use, diminished value, or consequential damages
• Vehicles used for commercial purposes without prior written approval
• Misfueling damage when diesel engine was not disclosed as required

7. Claims Process

In the event of an incident:

• You must notify us immediately at [contact information]
• You agree to cooperate fully with our insurance carrier’s investigation
• You will provide all requested documentation within 48 hours
• You will not admit fault or liability without our prior written consent
• You authorize us to inspect the vehicle and obtain repair estimates

8. Subrogation

You agree not to waive any rights of subrogation against third parties without our express written consent. We reserve the right to pursue claims against third parties responsible for any damage or loss.

9. Additional Insured

During the period our drivers are operating your vehicle, you are considered an additional insured under our liability policy, subject to the terms and conditions of that policy.

10. Insurance Verification

Upon request, we will provide you with a certificate of insurance demonstrating the coverage described herein. This certificate is for informational purposes only and does not alter the terms of the underlying insurance policy.

11. Indemnification

You agree to indemnify and hold harmless Request A Driver LLC, its officers, employees, and agents from any claims, damages, or expenses arising from:

• Your misrepresentation of vehicle condition, fuel type, or other information
• Your failure to disclose that your vehicle has a diesel engine
• Any damages resulting from misfueling when diesel engine was not disclosed
• Your violation of any terms of this agreement
• Any liens, encumbrances, or legal claims against your vehicle
• Your failure to maintain required vehicle registration or compliance

12. Changes to Coverage

We reserve the right to modify our insurance coverage amounts or carriers with 30 days’ notice posted on our website. Continued use of our services after such notice constitutes acceptance of the modified coverage terms.
